Man, 33, handed ban after pleading guilty to drink driving


A 33-year-old man from Derbyshire has been disqualified from driving for 17 months after pleading guilty to drink driving.

Albert Aleksander Dyba, of Dovetail Court, Chesterfield was sentenced when he appeared at Southampton Magistrates’ Court yesterday (Wednesday 22 January).

As well as the driving ban, Dyba has also been ordered to pay a fine of £120, costs of £85 and a victim surcharge of £85.

The sentencing follows an incident on Ashley Road, New Milton shortly after 10pm on Saturday 19 October 2024.

While driving his vehicle, Dyba swerved from the road, crashing into a wall and causing it to collapse.

When stopped by officers and breathalysed, Dyba had 70 micrograms of alcohol in 100 millilitres of breath, leaving him twice the legal limit to drive.

Investigating the incident, PC Tom Jelly, of New Milton Neighbourhood Policing Team, said: “I am pleased to see justice served here. Dyba clearly felt he could drink alcohol, drive his vehicle and not face any consequences for those actions.

“This prosecution and sentencing has proven that he was wrong. The ban he has received will now give him time to consider his actions and hopefully learn from this experience, safe in the knowledge that we will bring him before the courts again if he does similar in the future.

“Drink driving is extremely dangerous and can have devastating consequences for both the offending driver and other innocent people using our roads.

“This case should serve as a stark warning and reminder to all who drink alcohol and then choose to drive.

“Alcohol can take a considerable amount of time to leave your system, so make the right decision and do not drive unless you are absolutely certain you are fit to do so.”
